These Terms of Service ("Terms") govern your use of the Asetrix platform. By signing up for an Asetrix account or using any part of the platform, you agree to be bound by these Terms. The platform is operated by Asetrix Property Systems (Pty) Ltd, a company incorporated in the Republic of South Africa.
1. The service
Asetrix is a multi-tenant software-as-a-service platform for South African real-estate agencies. It includes a public marketplace, an agency portal (rentals, listings, inspections, billing, applications, mandates), a mobile API, and a vendor magic-link surface. We may add, change or remove features from time to time as the platform evolves.
2. Accounts
- You must be at least 18 years old and authorised to act on behalf of the agency you sign up.
- You are responsible for keeping your password secret and for all activity under your account.
- You must notify us at info@asetrix.co.za immediately on suspecting unauthorised access.
- Agency owners and principal agents may invite additional users with appropriate roles.
3. Acceptable use
You agree not to:
- Use Asetrix for any unlawful purpose or in violation of South African law.
- Attempt to access tenant data you have not been authorised to see.
- Interfere with or disrupt the integrity or performance of the platform.
- Probe, scan or test for vulnerabilities except as part of a coordinated disclosure to info@asetrix.co.za.
- Use the platform to send spam, harvest personal data, or run automated scraping.
4. Subscription & billing
- Pricing is published in the signup flow and the Admin → Billing dashboard. Plans renew monthly unless cancelled.
- Every new agency receives a free trial (currently 30 days, subject to change).
- Billing is processed by Stripe in ZAR. Failed payments enter a 7-day grace period before the account moves to a read-only state.
- You can cancel at any time; cancellation takes effect at the end of the current billing period.
- Fees paid are non-refundable except where required by South African consumer-protection law.
5. Your data
You retain all rights to the data you and your agency upload to Asetrix. We process that data on your behalf as an "operator" under POPIA — full detail is in our Privacy notice. You can export your tenant data at any time via the portal's export endpoints and request deletion within 30 days of cancellation.
6. Regulatory framework
Asetrix is designed to assist agencies with compliance under the Property Practitioners Act, 2019, the Rental Housing Act, 50 of 1999, the Consumer Protection Act, 68 of 2008, the Financial Intelligence Centre Act, 38 of 2001 (FICA), and POPIA. The platform records and stores information that supports compliance, but it does not provide legal advice — your agency remains responsible for fulfilling its regulatory obligations.
7. Third-party services
The platform integrates with third-party services (Microsoft Azure, Microsoft Graph, Stripe, Cloudflare, the Tenant Profile Network, etc.). Those services have their own terms which apply to your use of those integrations. We will let you know if a new integration changes how your data is processed.
8. Intellectual property
The Asetrix software, brand, templates, and design system are owned by Asetrix Property Systems (Pty) Ltd. We grant you a non-exclusive, non-transferable licence to use the platform for the duration of your subscription. No rights to copy, reverse-engineer, sub-license or resell the platform are granted.
9. Service availability
We aim for high availability but do not guarantee uninterrupted service. We schedule maintenance windows in off-peak hours and announce them in the portal at least 48 hours in advance where possible. Where downtime exceeds our published SLA, we may issue service credits — see your subscription agreement for detail.
10. Limitation of liability
To the maximum extent permitted by South African law, Pixel Core (Pty) Ltd's total liability arising out of or in connection with these Terms is limited to the fees paid by you for the platform in the 12 months preceding the event giving rise to the claim. We are not liable for indirect or consequential losses (loss of profits, loss of business opportunity, data corruption beyond what our backups can restore).
11. Indemnity
You agree to indemnify Asetrix Property Systems (Pty) Ltd against any third-party claim arising from your unlawful use of the platform, your breach of these Terms, or your breach of POPIA / FICA / PPA obligations.
12. Termination
We may suspend or terminate your account immediately on material breach of these Terms or on legal grounds. You may cancel at any time. On termination we retain financial records for the period required by FICA and otherwise delete or return your data within 30 days.
13. Changes
We may update these Terms from time to time. Material changes will be announced at least 14 days in advance by email to account-holders. Continued use of the platform after the change takes effect constitutes acceptance.
14. Governing law & jurisdiction
These Terms are governed by the laws of the Republic of South Africa. Any dispute will be referred to the courts of South Africa with jurisdiction.
